ian lanc has brought this to my attention, and asked that it be posted as advice to all Members. Whilst I haven't checked the fine detail, I believe it to be correct.
However, before taking action, I recommend you follow the supplied links to ascertain the situation for yourself.

"With the Government banning private companies from clamping cars these companies have now thought about another way of making/stealing money from the motorist and have come up with carparks which have a time limit and if you overstay you end up with a invoice/fine through the post which they have no power to make you pay and even some companies threaten you with the Courts/Bailiff's. Only 'Council' and 'Police' Tickets are enforceable. Some area's where there is no signs at all just camera's and you still get a fine through the post, These companies get your details from DVLA at a cost of ?2.50p each + ?2 postage

REMEMBER DO NOT PAY THESE FINES AND CHECK THE LINKS AND PASS ON TO ANY FRIENDS WHO MAY HAVE HAD FINES.

Thanks for putting this up and i'm sure there are hundreds out there who have fell into this trap
its about time the Government stopped this theft.

I'm on my 2nd ParkingEye notice, and had 3 EuroCarParks notices. All sent me uselss crap- about 6/7 letters per CIVIL PARKING CHARGE NOTICE (threatning letters- red chequers and alsorts!!!) All ignored... all threatened court... did they balls!!!

Just remember its all based on contract law (something I've studied as part of my ba law degree im doing), and furthermore the contract is created with the driver, NOT the vehicle owner as is the case with PCN's (which are issued by local authorities). Damages must only be for actual losses- of which will be very little or none.

PCN/FPN/ECN are all reserved terms- to be used by the appropriate authorities only (PCN- decriminalised parking by local authorities, ECN- criminalised parking by local authorities, FPN- Police- traffic offences, criminalised parking, even things like pissin in the street)

Please DO NOT ignore correspondance with police/local authorities- these, unless appealed successfully, are very much enforcable, either through courts or with local decrim. parking, by simply following the correct channels through to sherrifs officers/ballifs

If anyones in any doubt over anything you recieve, PM me and I'll take a look- even PCN's can be appealed pretty easily..

I'm so glad I have my Blue Badges!
I have lived in Tunbridge Wells for nigh on 10 years. I have had several Parking Tickets prior to getting the Badge, but if you appeal strongly, more often than not, I have found they back down.
I love my Xsara ;-)

Not sure if its true or not, but:

"disabled bays" and "mother and baby bays" have no legal standing on private property, so anyone can park in them. "Disabled bays" on public roads are only enforceable if there is a pole with a sign adjacent to the bay. Those without legal signs are unenforceable, and merely a courtesy for a nearby disabled driver.

Private parking enforcement will become illegal in November anyway.

true but supermarkets etc have to provide disabled bays due to the DDA but they mean nothing, for instance if you are temp disabled ie broken leg or whatever then you prolly wont have a blue badge but you can still park in the "private" ones any way =-

Woo hoo got my latest PPC ticket through today :D overstayed in a private car park by 13 minutes :D

Ignoring shall go just like the rest... I'm well practised at it :D

Great int they  O0 Town n City Parking at Asda aren't much fun. ParkingEye and EuroCarParks at the Co-Op (and loadsa other places) are much more persistant!

As are my good friends at the servicestations-C P Plus- me and them go back to my first trip south of da border.

And never paid any of these invoices/demands for money wot aint theres!!!!

got a pcn on saturday didnt have change for the pay and display machine, went to get change nearest place was the other side of the very large park on the way back paid for the ticket,went to put it in the car window only to find the pcn notice. the time between pcn and buying ticket is 27 mins not bad for saying i had to walk with a 3 yr old 3/4 of a mile each way to go and get change. just challenged the pcn will keep you posted on how i get on.

First rule of thumb with these losers...

MAKE NO CONTACT WHATSOEVER FROM DAY 1.

And eventually they give up.
